Brazil TRF3 president suspends CDA Gaming injunction that briefly revived Casa de Apostas, Betsul and Jogo Online
The president of Brazil’s Federal Regional Court of the 3rd Region (TRF3) on Friday, November 6, 2026, suspended a provisional injunction that had restored CDA Gaming Ltda.’s federal fixed-odds authorisation for Casa de Apostas, Betsul and Jogo Online. The Attorney General’s Office (AGU) said Judge Johonsom Di Salvo extended to CDA the same suspension effects applied on October 10 to Stake Brazil Ltda., keeping the three brands offline under Provisional Measure (MP) 1.394/2026 until a final judgment in the underlying case or a further decision by the TRF3 presidency.

Overview
- TRF3 president Johonsom Di Salvo on Nov. 6 suspended the CDA Gaming injunction that had revived three fixed-odds brands.
- AGU said the ruling extends the Oct. 10 Stake Brazil suspension effects to CDA until final judgment or a new presidency decision.
- On Nov. 3, TRF3 Judge Adriana Pileggi had restored Portaria SPA/MF 255/2025 for CDA in interlocutory appeal 5034200-15.2026.4.03.0000.
- Di Salvo cited risk to administrative public order and pointed to STF ADIs 8024, 8027 and 8028 on the MP.
Brazil’s federal betting ban briefly cracked open for one licensed operator—and then closed again within days.
On November 6, 2026, TRF3 President Luís Antonio Johonsom Di Salvo suspended the provisional authorisation that had allowed CDA Gaming Ltda. to resume fixed-odds operations under the brands Casa de Apostas, Betsul and Jogo Online, the Attorney General’s Office (AGU) said in an official notice published the same evening.
According to the AGU, the presidency decision granted the Union’s request and extended to CDA Gaming the same effects of the October 10, 2026 ruling that had barred Stake Brazil Ltda. from operating in Brazil (suspensão de liminar e de sentença No. 5032238-54.2026.4.03.0000). The November 6 suspension remains in force until final judgment in the underlying action or a later decision by the TRF3 presidency.
Di Salvo held that keeping an exceptional authorisation in place posed a serious risk to administrative public order, legal certainty and the effectiveness of the national betting policy. The AGU notice quotes the decision as stating that maintaining the relief “introduces a scenario of normative instability incompatible with the management of a nationwide public policy,” and notes that the constitutionality of MP 1.394/2026 is before the Supreme Federal Court (STF) in ADIs 8024, 8027 and 8028. Isolated lower-court exceptions, the president said, would undermine uniform application of the measure.
How CDA briefly got back online
CDA Gaming challenged the early extinction of its authorisation under MP 1.394/2026. The company holds Portaria SPA/MF No. 255/2025, an onerous federal authorisation for sports betting and online games—physical and virtual—under Casa de Apostas, Betsul and Jogo Online, originally valid through December 31, 2029, after payment of R$30 million, according to the TRF3 record.
On November 3, 2026, TRF3 Judge Adriana Pileggi de Soveral, sitting on interlocutory appeal (agravo de instrumento) No. 5034200-15.2026.4.03.0000 from mandado de segurança No. 5031432-52.2026.4.03.6100 (26th Federal Civil Court of São Paulo), granted anticipatory appellate relief. The signed decision restores, for CDA alone, the authorisation under Portaria 255/2025 by setting aside the extinguishing effects of Article 4 of MP 1.394/2026, and orders restoration of the electronic domains and the operational, financial and payment services needed to continue the authorised activity until final judgment or further court order. Pileggi described the MP’s failure to provide refund or compensation for the outlay as a “verdadeiro confisco” (true confiscation).
The Fazenda Ministry’s Prizes and Betting Secretariat has published that November 3 decision PDF on its transparency page for operators authorised after MP 1.394.
AGU then sought suspension before the TRF3 presidency. Friday’s order puts CDA back under the same nationwide ban that still covers other fixed-odds operators while Congress continues to process MP 1.394 (urgency regime from November 9; current deliberation window through November 23) and the STF hears related ADIs.
